Participant Waiver and Risk Warning
1. Activities and Locations
This Waiver applies to all tennis, sporting, and lifestyle activities (the Activities) conducted by City Community Tennis Pty Limited (the Organiser) at any of our managed tennis facilities and premises, including but not limited to:
- Alexandria Park Tennis Courts, Alexandria.
- Beaconsfield Park Tennis Courts and the Ted McDermott Building, Beaconsfield.
- St James Park Tennis Courts, Glebe
- Prince Alfred Park Tennis Courts and the Coronation Centre, Surry Hills.
- Turruwul Park Tennis Courts, Rosebery
2. Risk Warning & Acknowledgement
Pursuant to Section 5M of the Civil Liability Act 2002 (NSW), you are hereby warned that the Activities are ‘recreational services’ and involve significant and obvious risks to your health and safety.
By participating, you acknowledge and accept the following risks, including but not limited to:
- Physical Environment: Rough terrain, obstacles, overexertion, and extreme weather (heat/cold).
- Accidents: Collisions with other participants, spectators, or equipment.
- Injury: Physical or mental injury (sprains, broken bones, spinal injury, paralysis) or death.
- Unauthorised Activity: Risks arising from participating in coaching or hitting sessions conducted by individuals not authorised by CCT.
3. Medical Declaration
You declare that you are mentally and physically able to participate in the Activities. You consent to CCT staff or emergency professionals providing medical care or transportation if an injury occurs during your session.
4. Exclusion of Liability (NSW & Commonwealth Law)
To the full extent permitted by law (including Section 5N of the Civil Liability Act 2002 (NSW) and Section 139A of the Competition and Consumer Act 2010 (Cth)):
- Release: You release the Organiser from all liability for a failure to comply with any express or implied warranty or guarantee that the services will be provided with reasonable care and skill.
- Waiver of Rights: Your right to sue the Organiser for death or personal injury resulting from the Activities is excluded, except in cases of significant personal injury caused by the Organiser’s reckless conduct.
5. Booker & Guest Responsibility
If you book a court on behalf of others (Guests), you agree that:
- You have informed all Guests of this Waiver and Risk Warning.
- You accept these terms on behalf of all Guests you bring onto the premises.
- You warrant that you have the authority to bind your Guests to this Waiver.
- Indemnity: You will personally indemnify the Organiser against any claims brought by a Guest if that claim contradicts the terms of this Waiver.
6. Parent/Guardian Consent
Where a participant is under 18, a Parent, Guardian, or Supervisor must
- Consent to the minor’s participation.
- Provide the acknowledgments and indemnities in this Waiver on the minor’s behalf.
- Remain present to supervise the minor during the Activities.
7. Governance
This Waiver is governed by the laws of New South Wales. If any part of this Waiver is found to be unenforceable, the remaining terms remain in full force.
